ABOUT THE ARTIST

I'm Aleks (Tooth, online), a queer multimedia artist based in Canada. My work is found under the handle TOOTH&BRANCH.My artwork is varied and often experimental. I like to intertwine horror with nature, folklore, and fantasy in the exploration of deep wounds, healing, growth, and the haunting perseverence of the soul beyond death.My skills are available for commercial projects and licensing opportunities. Digital painting featuring your character as the central focus; the art direction and composition of each piece will be decided by the artist.
Finished piece may be full-body, partial, or close-up. Background may be detailed, painterly, or abstract. Regardless of what choices I make, the finished result will be of equal time and effort to any other commission of this type.

TERMS OF SERVICE

Please note that the Terms of Service on this page apply to PERSONAL USE commissions only.
By submitting a commission request, you confirm that you have read and agreed to these terms.


GENERAL
By sending payment, the Client automatically agrees to the Terms of Service outlined by the Artist.
The Artist reserves the right to refuse a commission.
The Artist reserves the right to cancel a commission at any point for any reason, including but not limited to: violation of the Terms of Service, poor communication, rude behavior or harassment, health issues, etc.
PAYMENT & REFUNDS Payment is expected upfront and will be requested via Square invoice. Work will not begin until payment is received in full.
Prices listed are a baseline; certain requests (e.g., excessive revisions or complex additions) may increase the overall price of the commission. See the EDITS & REVISIONS section for more details.
After the rough sketch has been made, the Client is able to receive a 50% refund if they decide to cancel the commission.
Exceptions can be made at the Artist's discretion to provide full or partial refunds due to unexpected circumstances, but only on incomplete illustrations; finished artwork is not refundable.
All prices listed are in Canadian dollars (CAD) and are subject to change in the future.
ARTWORK USE AND RIGHTSThe Artist retains full copyright ownership of the commissioned artwork and reserves the right to post sketches, process shots, timelapse videos, and the completed artwork to their website, Patreon, and any business / art social media accounts. Clients may request a Private Commission wherein the finished artwork and its production stages are not shared online; please note that this type of commission is subject to a Privacy Fee. The Artist retains the right to use their artwork for commercial and advertisement purposes by default.
The Client may only use the commissioned artwork for personal, nonprofit use. Reselling or redistributing the artwork to generate revenue (e.g., in the form of merchandise such as prints, stickers, apparel, book covers, etc.) is considered commercial use and is prohibited unless commercial use fees have been discussed, agreed upon, and paid.
The Client may reupload the public (watermarked) version of the commission as long as credit is provided in the description. [You can tag @toothandbranch on most socials or link back to this website: toothandbranch.com]
The Artist retains the right to reuse rejected sketches for future commissions or personal works.
Privatization of commissioned artwork or the purchase of commercial use rights must be negotiated when submitting a commission request, before payment is made, and will incur an additional fee. Requests to privatize or purchase rights after the artwork is completed will be denied.
The Client agrees that using my artwork in any blockchain-related technology (including but not limited to: NFTs, cryptocurrency, and future inventions in the space) is prohibited.
The Client agrees that using my artwork in any Artificial Intelligence (AI) technology (including but not limited to image generators or their databases, and future inventions in the space) is prohibited.
The Client may request to remain anonymous on uploaded artwork.
EDITS & REVISIONSClients may crop or resize their commissioned artwork as needed for PERSONAL use as icons, banners, wallpapers, and other non-commercial graphics. Clients may not edit the artwork itself or remove the Artist's signature without express permission. The Client may request edits and revisions of the artwork without charge at the sketch stage of the commission.
Edits requested beyond the sketch stage will incur an additional fee based on how much work / time they will require.
Revisions due to Artist error (e.g., missing a detail on the reference provided) will be rectified without additional charge.
The addition of details not shown on the provided reference, or otherwise communicated to the Artist before work begins, will incur an additional fee based on how much work it will require to perform the edits requested.
Major revisions such as a pose changes, palette changes, background changes, etc. will not be made after the sketch is approved by the Client.
COMMUNICATION & DELIVERY Turnaround time averages between 1 - 2 months. More complex pieces may take longer.
Any deadlines for completed artwork must be communicated prior to payment, as they may incur additional costs.
Commissions completed in 14 days or less may be requested as a "rush order" at 2.5 times the cost. This must be discussed at the time of submitting a commission request and is not guaranteed, as the availability of this offer depends on my schedule.
The Client may request updates at any time, but please be courteous; excessive requests (daily / hourly) will be considered harassment and will result in the cancellation of your commission.
An open line of communication goes both ways — if the Client does not respond to messages for an extended period of time, established deadlines may be pushed back and the commission may be cancelled altogether.
The Artist will provide a sketch draft of the commission to the Client for approval.
The Artist may provide additional updates to the Client for clarification or revision.
All completed commissions will be delivered through email as digital files (.PNG or .JPG/JPEG) unless specified.
The Client is responsible for the storage of digital files on their own personal devices or servers; the Artist is not responsible for the long-term storage of commissioned artwork files. If you have misplaced or lost a commission file, I will happily check if I still have it, but this is not guaranteed especially if a long time has passed (several months or years).
